Please review these Terms and Conditions of Use (“Terms”) carefully before using the services offered by Wizdom. These Terms constitute a legally binding agreement between you and Wizdom, governing your use of our website and mobile application, including all content and services. Note that this is a subscription service with automatic renewal. Familiarize yourself with our Subscription Policy, especially regarding payments and refunds, to understand the terms of subscription and trial periods. Indian customers should note that disputes will be resolved through arbitration as detailed in our arbitration clause. Also, these Terms contain important disclaimers, warranty disclaimers, limitations of liability, and a class action waiver.

Subscription Service

Wizdom operates on a subscription model that automatically renews. Please review these Terms and our Subscription Policy for details on billing and cancellation.

 

  1. General Terms for Wizdom

1.1 Agreement to Terms: By using Wizdom’s services, you enter into a binding contractual agreement, so it’s important to read these Terms carefully.

1.2 Privacy Policy and Other Documents: The Privacy Policy and other documents posted on Wizdom are integral parts of these Terms.

1.3 Changes to Terms: Wizdom may update these Terms, with critical changes notified via email or notifications. Continued use after changes implies acceptance.

1.4 Eligibility and Agreement: If you disagree with any part of these Terms or are not authorized to agree, do not use Wizdom’s services.

 

Arbitration Clause for U.S. Customers

The “Arbitration Clause for U.S. Customers” in Wizdom’s Terms and Conditions would specify that any disputes between the user and Wizdom will be resolved through binding arbitration, rather than in court. This means users agree to submit disputes to an arbitrator rather than pursuing a lawsuit. By agreeing to this clause, users also waive their right to participate in class action lawsuits or class-wide arbitration. 2.2 No Medical Advice: The app does not offer medical or healthcare advice. Users should consult healthcare professionals for medical concerns.

2.3 Authorship of Ideas: Ideas in summaries reflect the authors’ views, not Wizdom’s. The app makes no guarantees about the success of strategies discussed in the summaries.

2.4 No Author Endorsement: Authors mentioned in the app do not endorse or sponsor Wizdom. Summaries are not endorsements from these authors.

  1. Profile Registration

By creating a profile on Wizdom, you affirm that all personal information provided during registration is accurate and truthful. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. It is imperative to promptly update your information in the event of any changes and to immediately notify Wizdom of any unauthorized use of your account. Your commitment to these responsibilities ensures the integrity and security of your Wizdom experience.

  1. Intellectual Property

The content provided by Wizdom, including all textual material, graphics, user interface, and software, is the exclusive property of Wizdom. Users are granted a limited, non-exclusive, non-transferable license to access and use Wizdom’s content for their personal, non-commercial purposes. This license is subject to these Terms and does not include any right for resale, distribution, public performance, or any other use not expressly permitted. Unauthorized use, reproduction, modification, or distribution of Wizdom’s content is strictly prohibited and may result in legal action.

  1. Payments and Refunds for Wizdom

5.1 **Subscription and Purchases**: The Wizdom app can be downloaded at no cost. Some features within the app, however, may require payment either via a recurring subscription fee or a one-time payment for specific content outside the app. These transactions are referred to collectively as “Purchases” and can be made directly within Wizdom or through the App Store.

5.2 **Changes in Fees**: Wizdom reserves the right to alter the fees for its services. Any changes in pricing will be communicated to users in advance through email notifications, in-app notifications, or updates on the Wizdom website. Users who do not wish to accept these new fees have the option to cancel their subscriptions before the changes take effect.

5.3 **Payment Authorization**: By using Wizdom’s services, users authorize Wizdom and the App Store platforms to charge the fees associated with their chosen subscription or purchase to the payment method they have provided.

5.4 **Subscription Auto-Renewal**: Subscriptions to Wizdom’s services are set to auto-renew by default. This means that, unless canceled by the user, subscriptions will automatically renew at the end of each subscription period. The renewal fee will not exceed the rate of the immediately preceding subscription period, barring any special promotions or discounts. Users must cancel their subscriptions following the specific cancellation procedures provided by Wizdom to avoid being charged for the renewal.

5.5 **Trial Subscriptions**: Wizdom may offer trial subscriptions, which provide users with temporary access to the services for a specified period. Unless canceled before the trial’s conclusion, trial subscriptions will automatically convert into paid subscriptions, and the user’s payment method will be charged accordingly.

5.6 **Expiration and Non-Payment**: Rights to access and use Wizdom’s services are contingent upon timely payment. If a user fails to make the required payments, Wizdom reserves the right to suspend or terminate access to its services, potentially without notice.

5.7 **Refunds through App Store**: For subscriptions made through App Store platforms, the refund policy of the respective store applies. Wizdom itself does not directly process refunds for these purchases.

5.8 **No Refunds Policy**: All purchases made through Wizdom are considered final and are non-refundable, except in circumstances where mandatory laws stipulate otherwise. Wizdom reserves the right to offer refunds at its own discretion, in accordance with its policies.

**Note for EU Residents**: Users residing in the European Union have the right to cancel digital content purchases within fourteen days from the date of the transaction. However, this right is forfeited once the service is rendered or content is accessed before the end of these fourteen days.

  1. User Representations and Restrictions for Wizdom

6.1. By using Wizdom, you confirm that you are legally competent to agree to these Terms, are at least 16 years old, will not use automated means to access the Services, and will not use Wizdom for illegal purposes. You also affirm that you are not in a U.S.-restricted country or on any U.S. prohibited list, and your use complies with all applicable laws.

6.2. Wizdom reserves the right to restrict or terminate service if you provide false or incomplete information.

6.3. Wizdom’s Services should only be used for their intended purpose and not for unauthorized commercial activities.

 

  1. Users must not misuse Wizdom’s content or services, breach security features, engage in unauthorized linking or framing, overload the services, or create derivative works. Users also must not engage in activities that infringe on Wizdom’s terms, such as unauthorized use, distribution, reverse engineering, or conducting harmful activities like spreading viruses.

 

  1. Indemnification for Wizdom: When you use Wizdom’s services, you agree to protect Wizdom, its parent company, subsidiaries, affiliates, officers, directors, employees, agents, and licensors from any legal claims, damages, losses, liabilities, settlements, or legal fees arising from your use of the services, your content, or your violation of these Terms. This includes but is not limited to the responsibility for your own conduct while using Wizdom and the consequences of any misuse by you, including legal actions taken against you and by extension, any impacts on Wizdom as a result of your actions.
  1. Disclaimer of Warranties for Wizdom: Wizdom is offered to users in an “as is” condition without any form of warranty. This means that Wizdom does not provide any guarantees regarding the merchantability, fitness for a particular purpose, or non-infringement of intellectual property. Furthermore, Wizdom makes no warranty about the reliability, quality, or accuracy of its services. Users should understand that by using Wizdom, they do so at their own risk and discretion and that the service may not meet all of their requirements or expectations.
  1. Limitation of Liability for Wizdom: Wizdom and its service providers are not liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use of, or inability to use, the service. This includes damages for loss of profits, goodwill, use, data, or other intangible losses. The liability of Wizdom, in any case, is limited to the greater of the amount paid by the user for the service or $100. This limitation applies even if Wizdom has been advised of the possibility of such damages regardless of the theory of liability.
  1. International Use for Wizdom: Wizdom’s services are not represented as being appropriate or available for use in all locations around the world. Users from different jurisdictions should be aware that they are responsible for ensuring that their access to and use of Wizdom complies with local laws and regulations. This means that users outside the regions where Wizdom explicitly offers its services must determine the legality and appropriateness of these services within their own legal jurisdiction.
  1. Mandatory Binding Arbitration and Class Action Waiver for Wizdom:

 

**11.1 Mandatory Arbitration of Disputes**: All disputes related to these Terms or the use of Wizdom services will be resolved through binding, individual arbitration, not in court. This includes waiving the right to participate in class actions.
